ABC to Stand Trial for ‘General Hospital’ Firings During Covid-19 Vaccine Mandate

In a lawsuit filed by two former crew members of General Hospital, ABC will now have to face trial. The crew members are suing ABC on religious discrimination claims after they were fired for refusing the COVID-19 vaccination.

The Los Angeles judge’s ruling marks the first time there would be a trial over terminations due to the vaccine mandates adopted by major studios during the COVID-19 pandemic.

According to the Hollywood Reporter, in the ruling delivered on Tuesday February 20th, involving ex-GH crew members, James and Timothy Wahl, it is said they may have had “sincerely held” religious beliefs that ABC should have accommodated by affording them exemptions, and allowing them to follow safety protocols implemented before the mandatory vaccine policy was rolled out.

This lawsuit began in 2022 when father and son James and Timothy Wahl, who previously worked in the special effects department of General Hospital, sued ABC after their requests for religious exemptions were denied. At the time, it was noted that ABC had uncertainty as to whether their objections to taking the vaccine were based on their Christian faith.

ABC had argued that the Wahls did not have genuine religious beliefs and that, even if they did, it could not have accommodated them without undue hardship. It also claimed that IATSE (union for crew members and behind the scenes personnel) waived any rights members had to object to mandatory vaccination policies.

In the summary judgment, the Los Angeles court came to the conclusion that ABC may have actually discriminated against the Wahls on the basis of their religion by failing to find a workaround situation for them when they refused to be vaccinated.

Unlike the case of Ingo Rademacher (ex-Jasper Jacks), in which the former General Hospital lost his lawsuit, the court noted that workarounds were not possible for actors performing onstage as it required him to work in very close proximity with other cast members without a mask, which could endanger their safety. The case for the Wahls also does not apply to the termination of Steve Burton (Jason Morgan) back in 2021. Burton is now back on the ABC soap opera following the lifting of the mandates.

However, in the case of the Wahls, they worked in the construction and special effects shops for GH, and while they, at times, had to go to “Zone A” of the production, where the cast films, they tested regularly for COVID-19, always wore a mask and did their best to socially distance from the cast.

Just say… remember when some OLTL characters went to GH while Prospect Park had the rights to them? Characters names are copyrighted. Google it.

You do bring shame to a wonderful character name the lovely and talent Kim Zimmer played. You could never compare.

Based on the information provided, it sounds like the crew members followed all safety protocols and did everything that was required of them. What’s the point of having religious or medical exemptions if they aren’t going to be respected by your employer? The fact that it came to people losing their jobs is crazy, especially given that now all mandates have been lifted and COVID is still around. I hope they win this case.

I would like to ask these mortals which “sincerely held religious beliefs” object to vaccines, because I seem to recall pretty much every religion endorsing vaccinations when they first rolled out. Catholics, Protestants, Jews, Muslims, Buddhists, Hindus. And even the Devil myself.

Don’t remember if the Scientologists took any side officially, but I’m assuming they must have, because Tom Cruise never stopped working.

If you want to drink bleach or horse dewormer that’s up to you. But you have no right to possibly give someone else a disease that could possibly kill them – especially babies, those who are immunocompromised, or the elderly. We are still seeing 1500 people a day being hospitalized from this disease. Grow up & be responsible.

Satan always plays a good game of understood humor. Just like the soaps themselves, Don’t allow yourself to read to much into comments. Just laugh them off and carry on.

I am unaware of any Christian denomination that objects to vaccines. In fact, from what I remember, many different faith communities sponsored vaccination events at their houses of worship. I am no supporter of the alphabet network or the mouse company, but from what has been reported, it sounds like this lawsuit doesn’t hold water.

The religious excuse is such bs.

While I’m immediately skeptical when I read about “religious” objections to vaccines, I do wonder if there are (very limited) religious denominations that actually do object–for example, Christian Scientists. As I recall, they don’t do things like blood transfusions from other people (I think they can store up their own blood if they need it for an operation, but I could be wrong about that); anybody here know Christian Scientists’ stance on vaccines (ALL vaccines, not just the Covid one)? What about the Amish and similar groups that eschew many of the modern conveniences we take for granted?

I won’t prejudge, but it does sound as though because they worked behind the scenes and could do their jobs in more isolation, these two workers might have had a stronger case than Steve Burton and A-Dingo-Ate-My-Lawsuit. I’ll be interested to see how it plays out.

Adam Huss Makes Another Return to General Hospital as Nikolas Cassadine

Nikolas Cassadine will be back on your screens next week but now via Pentonville. That means, that actor Adam Huss is back for a visit for all-new episodes of General Hospital.

In story, Ava (Maura West) comes to visit her ex in the slammer. So, just what does Ava want now? She clearly has been working an agenda on Sonny (Maurice Benard). Is she working with Valentin (James Patrick Stuart)? What will she tell Nikiolas? stay tuned.

Meanwhile, once news of Huss’ return broke earlier on Friday via Soap Opera Digest, he also announced his return on his Instagram expressing, “For all those who’ve been asking, cat’s out of the bag;) Thank you to all my #Nikolas #GH fans for your unwavering support. I don’t take it for granted for a second! (Even when I can’t answer 😊) #generalhospital”

Huss took over the role of Nikolas back in January of 2023, after Marcus Coloma left the soap opera. Previous to that, Huss filed in for Coloma in September of 2021 and November of 2022. Fast-forward to January of 2024, Nikolas gave Ace to Laura and Kevin to raise, while he eventually turned himself into the police for kidnapping Esme and keeping her hostage while she was pregnant and Wyndemere.

The return of Huss comes on the heels of multiple reports that his on-screen son, Nicholas Chavez is not returning to the show as Spencer Cassadine, while in story Spencer is believed to have drowned int the Seine River after falling off a boat in France, when drugged by Esme.

GENERAL HOSPITAL: Sonny and Jason Trade Threats on Each Other

The love affair that once was mobster Sonny (Maurice Benard) and hit man Jason (Steve Burton), and having each others back, is now apparently over! On the Thursday April 25th episode of General Hospital, an increasingly paranoid Sonny is confronted by Jason.

Jason wants to talk to Sonny about a “family matter”, but Sonny says they aren’t family now because he’s working with the Feds. Sonny goes on to say how he cannot trust Carly (Laura Wright) or Jason and he knows about Jason buying back the Metro Court for Carly from Nina (Cynthia Watros).

When the conversation turns to Josslyn (Eden McCoy) and Dex (Evan Hofer), Jason informs Sonny that Kristina (Kate Mansi) knows Sonny ordered a hit. Jason is worried about Dex’s safety. He tells Sonny that if he does something to Dex, Kristina will figure out that he is responsible.

Sonny goes on to say how much he loves his kids and how he will protect them. He then tears into Jason for abandoning his sons, Danny and Jake, for two years and how he has no right to stand there to tell him what to do.

Jason warns Sonny again to leave Dex alone or he’ll personally stop him. Sonny snaps at Jason, countering, “You’ll die trying!” And at that point, Jason walks out and Sonny slams the door behind him.

REPORT: Nicholas Chavez Not Returning to General Hospital

For those who were holding out hope that Daytime Emmy winner and fan favorite, Nicholas Chavez would be returning to General Hospital after filming his leading role in Ryan Murphy’s Monsters anthology, it looks like those hopes have been dashed.

According to a report from TV Line, although unconfirmed from General Hospital or a representative for Chavez, the actor will not reprise his role as Spencer Cassadine on the long-running ABC soap opera and continue the love story of Sprina opposite Tabyana Ali (Trina, GH).

Chavez was cast as Lyle Menendez over the the summer of 2023 for the second season of Murphy’s limited Monsters series on Netflix. In the upcoming season, the series will focus on the the case of Lyle and Erik Menendez, the two well-to-do Beverly Hills brothers accused of murdering their parents in 1989.

After word from Chavez casting was revealed, GH fans were concerned over the fate of the Sprina story, a spokesperson for GH shared,  “We support Nicholas’ endeavors and look forward to having him return to General Hospital once this project is wrapped.”

In story, the series “killed off” Spencer when he went overboard with Esme to the steely waters below after being injected with a drug, thanks to Esme and falling into the Seine River in France. However, his body was never recovered, and believed to have drowned or washed away. Thus, leaving an opening for Spencer to return in the form of Chavez or be recast down the line.

TV Line shared that ‘multiple sources’ are confirming that Chavez is not returning to the ABC soap opera, which is what many had suspected might be the case once he left for this major starring role in a Ryan Murphy project. Chavez has been relatively quiet on social media for months.

The Michael Fairman Channel spoke with Nicholas Chavez for a virtual interview when he first joined the show in 2021, and spoke to him right after when he won the Daytime Emmy in 2022 – you can see those below.

No word yet on when Monsters: The Lyle and Erik Menéndez Story will debut on Netflix, but it is assumed later this year.
