ABC Denied Motion To Strike Prospect Park's Amended Complaint In Lawsuit On License Agreement For AMC & OLTL!

This morning there was a development in the lawsuit of Prospect Park vs. ABC over the production company’s licensed soaps from the network, All My Children and One Life to Live!

Following a 50-minute hearing, Judge Robert Hess in L.A. Superior Court denied ABC’s motion to strike the part of the Prospect Park’s amended complaint, in which the company who brought back the series online in 2013,  asked to have the license agreement for the two soaps extended and payments to ABC “excused” while the nearly year-old breach of contract suit for more than $100 million moves forward.

According to a report from Deadline.com, which has the details:  “Trial lawyer James Edward Maloney of Texas’ Andrews Kurth represented Prospect Park, while Susan Klein and Nuritsa Ksachikyan of LA’s Valle Makoff were there for ABC. “Prospect Park exercised its option —  it produced an entire season of the series,” Klein argued early in the hearing. “It can’t ask the court to rewrite what the parties have negotiated.” Judge Hess saw it differently: “After hearing the arguments from them and you, I’m going to let them leave it in,” he told Klein.

In a brief recap of key points to the on-going lawsuit Deadline related: “ABC filed the motion to strike on January 13th of this year,  two months after Prospect Park filed its amended version of its initial April 2013 complaint seeking “at least $30 million in out-of-pocket losses and/or at least $95 million in lost profits” from the network. The November 13 amended complaint alleges that ABC has been breaking the licensing agreement, claiming the network inked long-term agreements with OLTL actors, killing off OLTL characters on loan to General Hospital and deliberately attacking Prospect Park’s efforts to continue AMC and OLTL online.

The licensing agreement ABC and Prospect Park first entered into in July 2011 — after the network cancelled the two long-running soaps — gave the production company 12 months to put together online versions of the shows. Prospect Park would then have the exclusive right to produced 15 seasons of each show. However, the agreement, which was amended in January 2012 after various delays, also said that if Prospect Park doesn’t produce the shows for 18 straight months then rights shall revert back to ABC. The network wants to hold by that deal. Prospect Park, which launched the series in April 2013 but suspended them after around 40 episodes, obviously does not.”

So what comes next?  “ABC now has 20 days to respond to Prospect Park’s amended complaint. The next hearing in the case on the court schedule is a conference-case management meeting set for March 13.”

I agree! Todd Manning can star in his own show, maybe a talk show replacing Katie. He can hold his guests hostage wearing fake dynamite. 😉 (Anyone remember that story?) It no longer matters what happens now or even who did what. It’s all over for OLTL/AMC. ABC won’t admit making the biggest mistake in TV history since the WB and UPN merged to make that Country Western network. And PP blew a slam dunk sure thing and has lost all fan support. I hear a large lady singing. ;-(

Whether AMC or OLTL eve r come back, and I still have a slim hope they will one day, I want ABC to lose. I don’t think that they dealt fairly with PP and I hope PP gets some satisfaction, financial and otherwise, from this lawsuit. I have issues with how PP handled itself with the reboots, heaven knows I do. PP wasn’t as polished and organized as they should have been, and they made a number of bad decisions both in front of and behind the camera. Where I take issue with prospect park is they had issue with the way GH was using the OLTL Characters yet never said nothing until long after the whole thing occured. Prospect Park is just looking for a source of money and I honestly don’t think their suit has a lot of merit but I am no legal expert. Will have to see how it plays out in court!

They screwed PP and tried to stop any production of those shows so they were not as seen as the idiots they are for cancelling them 2 shows to begin with. They will pay, they BLANTLY breached those contracts anyone with eyes can see that! Wow Jolie a bit hysterical aren’t we over this. I am glad you are a judge and a lawyer and know all the facts. First off they didn’t breach contracts. Secondly if Prospect Park had issue with the storylines they should have complained about it when it happened. But instead they waited until they realized they didn’t have the money to keep their garbage versions of OLTL and AMC going. So they came up with this lawsuit. First of all David, When they lose this lawsuit they are going to lose more than money, they are going to lose credibility when it comes to making deals. Not everything is about money David! Actually Joliefan do you think a lawsuit over a daytime serial is going to ruin the reputation of ABC/Disney, lol. Far from it. First off Prospect Park has to prove their claims that GH/ABC/Disney didn’t have th right to use said characters. Enough is enough. They both should settle this and find a way to bring back both soaps to television. One Life to Live was the best soap opera out there. The only loser here is the fans who miss their beloved soap. Sorry, but Port Charles doesn’t hold a candle to Llanview. Funny you say that ” Port Charles doesn’t hold a candle to Llanview” SERIOUSLY??? OLTL is never coming back and the reboot was not what ANYONE expected. First they had the swearing and then the obvious look of sex in clubs, it was doomed from the get go!!! Michael Easton was all set to do OLTL online…and he has said that he was disappointed that it all fell through. He has also stated he misses John McBain. With that said actors act…they play different people. So while it takes some getting used to…John no longer exists…and Silas does. The problem is that in my opinion the writers are writing Kikki, Franco and Silas very similarly to their former “selves.” I think it was their way of getting to use the characters while “hiding” them under different identities. Whoever wins this suit, I hope the intent is for SOMEONE to produce the shows again. At this point, I don’t care who. I don’t trust ABC, but they have the resources to produce the shows well if they want to, and I didn’t care as much for PP’s version of the shows, but at least they had the desire and cared about the shows, even though they made a lot of mistakes along the way. No I do not want PP to win. They are suing each other wanting out of investors agreements. They win the rights then they can shelved them for fifteen years. Robin Strasser even tweeted she wasn’t getting paid from PP. I hate ABC but PP was given every opportunity to do these soaps and screwed them up. ABC even structured the money they owed to help them launch them. What gets me PP is working on a series that is going to be on ABC. Is all about money and nothing about our soaps…

Prospect Park is one of the most childish, incompetent companies I have ever seen in the entertainment industry. The fact that they are suing over FICTIONAL characters, as well as contracts with people who were NOT under contract with PP, is absurd. Suing over the deaths of Cole and Hope Thornhart is ridiculous. Before the whole lawsuit debacle, the General Hospital writers were setting it up to bring both characters back- why couldn’t Prospect Park? For me it’s not even about PP relaunching AMC or OLTL again. I think even entertaining that thought is too optimistic for me at this point, for all the reasons you folks have already pointed out. How did Prospect Park act any better than ABC? PP didn’t even have the DECENCY to tell the actors when the shows were “shelved”, they were accused of not paying union workers, Robin Strasser has recently said they have yet to pay her, etc. If you want to discuss how “badly” the cast and crew of these shows were treated, you must admit to PP’s behavior as well.

Not one network will take them on, you could not give them away the expense if huge to produce them nobody wants the soaps..

The only hope in our life time to see either of the two soaps is through Prospect Park..

I understand everyone’s frustration, but there’s always a chance, albeit a slim one I admit, that the shows could yet resurface. Keep in mind they were never OFFICIALLY cancelled but rather, “shelved” as in put on a back burner. So many people are still in denial, ABC canceled the shows because a few million quit watching. I made peace three years ago, the era of me watching soaps ended. Prospect park thought they could make money online but obviously they couldn’t. No one is ongoing to remake these shows as there is no money to be made. Low ratings were a topic of discussion with Carolyn Hennessy and Sonia Blangiardo interview. NO investor will take a risk on a low rated project. Was their Only ONE investor who was interested in the beginning? PP scrambled for funds that they ran out of for any project. Did not do their homework well enough.

Congrats to PP. I hope PP wins the entire lawsuit. ABC cancelled OLTL, and then they immediately hired the OLTL producer, writing team, some directors, and 3 actors for GH. This put PP at a very strong disadvantage for the reboots. If ABC liked these OLTL people, why did they cancel OLTL in the first place? The way ABC acted is very suspect, and ABC should be held accountable. The OLTL reboot was finally getting good in the last several weeks of its season. I hope OLTL comes back as I cannot watch GH.

Firstly, when ABC hired OLTL’s executive producer and headwriter, it was AFTER Prospect Park announced that they would NOT being going through with the reboots. They changed their minds after Frank and Ron were both under contract, as well as Roger Howarth, Michael Easton, and Kristen Alderson. Michael and Kristen never planned on coming onto the online reboot of OLTL so their availability should not have been a factor of success at all. I don’t think PP will keep the licensing rights. They will win some dollars but the court seems to be pushing for some kind of settlement for once and for all. ABC takes back the shows and at a heavy price. That is a negotiated settlement with both parties having to give to get. PP made huge mistakes and I will not drink the PP koolaid because they need to be held accountable for all their massive mistakes. PP is not without fault and failure. It was just hinted at in an article (on line) that ABC was/is not overly enthralled with THE CHEW’S viewing numbers. Certainly it cost less to produce, considerably less I would imagine – but people aren’t tuning in and the same article “suggested” that, if there was “a time machine available” (this is not my wording) that ALL MY CHILDREN’S fate would be quite different.
It was a gigantic blunder to cut both AMC and OLTL without at least considering other models of the show and exploring other options.

I guess Tom and Vicki missed the recent press releases where The Chew did its best ratings every and is performing extremely well in the key demos. And their numbers are at the point where they are doing what AMC was doing in that time slow. At half the cost The Chew is a huge success for ABC.

ehh…… who cares at this point. I watched all 3 soaps on ABC. Started when I was about 14 yrs old now I’m 52. I was sad when they took AMC and OLTL off. So GH “killed” off two OLTL characters. Soaps have been “killing off” and then bringing characters back to life for decades. All Prospect Park had to do was tell their writers to “bring back” the characters GH killed off! Geesh! I think that part of their complaint should be dismissed. Unless facts have come forward that I’m not aware of, PP didn’t allow GH to use OLTL characters. ABC, assuming that OLTL and AMC would never get off the ground, went forward with it unilaterally. When PP’s version of OLTL did in fact materialize, ABC was stuck, because the GH characters were part of the package that PP “purchased” (or “rented”) from ABC, but the actors were under contract to GH. GH was the best soap opera back in the day. It had the best cliff hangers and more realistic stories even though it is just a soap. Now, the stories are so far fetched. I do not know what is going on because they keep adding more characters, shelving others that have been there for years, and changing how characters usually portray in a situation. There are more and more people tweeting on line that there is every chance that either ALL MY CHILDREN or One Life to Live will indeed be back in one form or another – the viewing numbers were very good on line and there is interest in reviving one or both shows – there are also strong rumors that the two shows will be combined. If they bring either ONE LIFE TO LIVE and/or ALL MY CHILDREN back (a huge “if)
it would have to be with new characters and new actors sprinkled in with whomever is available at the moment. Some re-casting would be necessary ~ it’s highly unlikely that at the present time, the shows could have a come-back – but nothing is impossible.

All My Children Alum Ben Jörgensen Reportedly Dead At 51

According to his former All My Children castmate, Brian Gaskill. there is sad news in the soap world today.  Ben Jörgensen who played Kevin on All My Children and Chris on As the World Turns passed away on Tuesday at the age of 51, apparently via suicide, although unconfirmed as to his cause of death.

Gaskill, who played Bobby Warner while in Pine Valley shared via his Instagram:  “Sad news to report. Ben Jörgensen who played Kevin Sheffield on All My Children has past away at 51 years old.  My understanding is it was suicide.  I have heard he suffered from Bipolar disorder but as I have not spoke to him in years I do not know all the details. I just want to remember the good times we had on the set of All My Children 24 years ago. He was a good guy and had the courage to play a gay teenager on tv back when it was nowhere near as common to have representation as it is today. He was part of an award winning storyline…but mostly we just had some good times back then…my condolences go out to his friends and family. Please everybody hang in there and reach out for help if you need it. ”

On All My Children, Ben was part of the important social issue storyline brought into the ABC legacy soap opera by the iconic Agnes Nixon, who was always trying to move the needle forward in daytime, as the character of Kevin was a gay high school student facing bullying, ridicule and discrimination for his sexuality.

Hallmark Channel’s ‘Home & Family’ Returns to Production For Ninth Season; Premiere Date Revealed

Another daytime show is heading back to production amid the coronavirus pandemic.  Now comes word that Hallmark Channel’s flagship morning lifestyle series, Home & Family has returned to production at its Universal Studios set for its ninth season.

All My Children favorite Cameron Mathison (Ex-Ryan Lavery) and Debbie Matenopoulos will return as co-hosts .

Look for the new season to kick-off on Monday, September 14th at 10am EST.

In a statement, Home & Family executive producer, Tracy Verna Soiseth shared: “We are thrilled to be returning to our home for the new season. Home & Family is a daily destination of comfort television, and we are very happy to be returning with two hours of daily interviews, cooking segments, DIY crafts and our hugely popular animal adoptions.”

For the past several months. a daily series featuring the cast called At Home with Our Family has run across the show’s social media platforms during the Covid-19 pandemic.

According to Deadline,premiere-week guests are to include: Jenna Bush Hager, Danica McKellar, celebrity chefs Jet Tila, Carla Hall, Buddy Valastro, Curtis Stone, Rashad Jennings and Dennis Quaid.

Michael B. Jordan Pays Tribute To Chadwick Boseman: “Since Nearly The Beginning Of My Career, Starting with All My Children When I was 16 Years Old You Paved The Way For Me”

Following the news of the tragic death of now motion picture icon, Chadwick Boseman late Friday, tributes and sentiments have poured in from celebrities, politicians and fans from all across the world.

Chadwick Boseman passed away late last week at the age of 43 from colon cancer – a battle he kept silent about for the last four years of life.

No one could be more intertwined with Boseman’s career than that of his fellow Black Panther star, Michael B. Jordan.  For Jordan took over the role of Reggie Porter on All My Children from Boseman after the late actor lasted one week, following standing up to, and addressing concerns, of racial stereotypes in the way that the part was written.  Reggie was introduced to Pine Valley as a gang member in 2003.  As previously reported it was Boseman who helped the soap opera improve the role that Jordan took over with some recommendations.

Now Michael B. Jordan has written a heartfelt remembrance of Chadwick that he shared on his Instagram, and what he has meant to his life, including how he showed him how to be better, to honor purpose and create legacy.

“I’ve been trying to find the words, but nothing comes close to how I feel. I’ve been reflecting on every moment, every conversation, every laugh, every disagreement, every hug…everything.

I wish we had more time.

One of the last times we spoke, you said we were forever linked , and now the truth of that means more to me than ever. Since nearly the beginning of my career, starting with All My Children when I was 16 years old you paved the way for me. You showed me how to be better, honor purpose, and create legacy. And whether you’ve known it or not…I’ve been watching, learning and constantly motivated by your greatness.

I wish we had more time.

Everything you’ve given the world … the legends and heroes that you’ve shown us we are … will live on forever. But the thing that hurts the most is that I now understand how much of a legend and hero YOU are. Through it all, you never lost sight of what you loved most. You cared about your family , your friends, your craft, your spirit. You cared about the kids, the community, our culture and humanity. You cared about me. You are my big brother, but I never fully got a chance to tell you, or to truly give you your flowers while you were here.
